                   AN ORDINANCE TO AMEND ORDINANCE NO. 6958, AS
                   AMENDED, KNOWN AS THE ZONING ORDINANCE, SO AS
                   TO REZONE A TRACT OF LAND LOCATED IN THE 1600
                   BLOCK OF WEST 40TH STREET, BEING ON THE
                   NORTHEAST LINE OF WEST 40TH STREET SOUTHEAST OF
                   OLD MOUNTAIN ROAD FROM R-2 RESIDENTIAL ZONE TO
                   C-2 CONVENIENCE COMMERCIAL DISTRICT, SUBJECT TO
                   CERTAIN CONDITIONS.

              	   SECTION 1.  BE IT ORDAINED BY THE CITY COUNCIL OF THE
         CITY OF CHATTANOOGA, TENNESSEE, That Ordinance No. 6958, as
         amended, known as the Zoning Ordinance, be and the same is 
hereby
         amended so as to rezone:
               
                A tract of land located in the 1600 block of West
                40th Street, being on the northeast line of West
                40th Street southeast of Old Mountain Road.  Part
                of lot 5, Subdivision of E. Kirklin's 40 Acre
                Tract, not recorded, being the property described
                in deed book 1557, page 353, R.O.H.C.,  Tax Map No.
                155O-E-14.
        
         from R-2 Residential Zone to C-2 Convenience Commercial 
District.
              	   SECTION 2.  BE IT FURTHER ORDAINED, That this rezoning 

         shall be subject to the following conditions:
        
              1.   That the above-described tract of land be used
                   for parking lot use only.
        
              2.   All existing easements are retained.
        
        
              	   SECTION 3.  BE IT FURTHER ORDAINED, That this 
Ordinance
         shall take effect two weeks from and after its passage, the 
public
         welfare requiring it.
